The Court has approved the distribution of the Net Settlement Fund to the claimants whose Proofs of Claim were accepted by the Court.

On or about December 22, 2008, distributions were mailed to the Authorized Claimants. There were 1,209 valid Proof of Claim forms submitted representing a total Recognized Loss amount of approximately $22,693,266.30. The Net Settlement Fund available for distribution was approximately $6,408,023.67. Accordingly, each Authorized Claimant has been paid approximately 28% of his, her or its Recognized Loss amount. Authorized Claimants with Recognized Loss amounts resulting in check amounts of $10.00 or less were not issued checks as previously stated in the Notice of Settlement.
